In a virtual press briefing, Sotto said the ruling altered the constitutional design of impeachment and may take decades to undo through jurisprudence alone.
“Ako, ayaw ko ng con-con, ayoko ng constituent assembly. Pero kapagka ganyan ang usapan, payag na ako (I do not like a constitutional convention, I do not like a constituent assembly. But if this is the situation, I am willing),” he said.
He warned that the decision could leave Congress with no choice but to amend the 1987 Constitution and reiterated that it encroached on Congress’s powers.
“It is nothing short of a judicial legislation. Inamend ang Konstitusyon sa pananaw ko (It amended the Constitution, in my view),” Sotto said, adding that impeachment rules were made more restrictive than what the framers intended.
Sotto said his position was based on constitutional principle and not on the personalities involved in the case.
“My position and my comments have nothing to do with personalities… ang legislation ay sa Congress, hindi sa Supreme Court (legislation belongs to Congress, not to the Supreme Court),” he said.
He said the Senate may consult the House of Representatives on the next steps in response to the ruling.
He noted that constitutional remedies may be necessary to clarify the impeachment process and restore the balance of powers among the branches of government. (PNA)
