CONSTITUTIONAL PROVISIONS

1987 PHILIPPINE CONSTITUTION
ARTICLE IX-D
THE COMMISSION ON AUDIT

SECTION 1 (1). There shall be a Commission on Audit composed of a Chairman and two Commissioners, who shall be natural-born citizens of the Philippines and, at the time of their appointment, at least thirty-five years of age, certified public accountants with not less than ten years of auditing experience, or members of the Philippine Bar who have been engaged in the practice of law for at least ten years, and must not have been candidates for any elective position in the elections immediately preceding their appointment. At no time shall all Members of the Commission belong to the same profession.

SECTION 1 (2). The Chairman and the Commissioners shall be appointed by the President with the consent of the Commission on Appointments for a term of seven years without reappointment. Of those first appointed, the Chairman shall hold office for seven years, one Commissioner for five years, and the other Commissioner for three years, without reappointment. Appointment to any vacancy shall be only for the unexpired portion of the term of the predecessor. In no case shall any Member be appointed or designated in a temporary or acting capacity.

SECTION 2 (1). The Commission on Audit shall have the power, authority, and duty to examine, audit, and settle all accounts pertaining to the revenue and receipts of, and expenditures or uses of funds and property, owned or held in trust by, or pertaining to, the Government, or any of its subdivisions, agencies, or instrumentalities, including government-owned or controlled corporations with original charters, and on a post-audit basis: (a) constitutional bodies, commissions and offices that have been granted fiscal autonomy under this Constitution; (b) autonomous state colleges and universities; (c) other government-owned or controlled corporations and their subsidiaries; and (d) such non-governmental entities receiving subsidy or equity, directly or indirectly, from or through the Government, which are required by law or the granting institution to submit to such audit as a condition of subsidy or equity. However, where the internal control system of the audited agencies is inadequate, the Commission may adopt such measures, including temporary or special pre-audit, as are necessary and appropriate to correct the deficiencies. It shall keep the general accounts of the Government and, for such period as may be provided by law, preserve the vouchers and other supporting papers pertaining thereto.

SECTION 2 (2). The Commission shall have exclusive authority, subject to the limitations in this Article, to define the scope of its audit and examination, establish the techniques and methods required therefor, and promulgate accounting and auditing rules and regulations, including those for the prevention and disallowance of irregular, unnecessary, excessive, extravagant, or unconscionable expenditures, or uses of government funds and properties.

SECTION 3. No law shall be passed exempting any entity of the Government or its subsidiary in any guise whatever, or any investment of public funds, from the jurisdiction of the Commission on Audit.

SECTION 4. The Commission shall submit to the President and Congress, within the time fixed by law, an annual report covering the financial condition and operation of the Government, its subdivisions, agencies, and instrumentalities, including government-owned or controlled corporations, and non-governmental entities subject to its audit, and recommend measures necessary to improve their effectiveness and efficiency. It shall submit such other reports as may be required by law.

Philippine Transparency Seal

A pearl buried inside a tightly-shut shell is practically worthless. Government information is a pearl, meant to be shared with the public in order to maximize its inherent value.

The Transparency Seal, depicted by a pearl shining out of an open shell, is a symbol of a policy shift towards openness in access to government information. On the one hand, it hopes to inspire Filipinos in the civil service to be more open to citizen engagement; on the other, to invite the Filipino citizenry to exercise their right to participate in governance.

This initiative is envisioned as a step in the right direction towards solidifying the position of the Philippines as the Pearl of the Orient – a shining example for democratic virtue in the region.

Monday’s address is the people’s SONA

Featured Story

Monday’s address is the people’s SONA, says Aquino July 23, 2013
Midway into his six-year term in office, President Benigno S. Aquino III said the State-of-the Nation Address (SONA) he delivered on Monday is an address by the Filipinos who believed that change is possible and there’s a bright future for the country.

“Sa bawat Pilipinong nagtitiwala sa kapangyarihan ng maliliit na anyo ng kabutihan: Kayo po ang gumawa ng pagbabago. SONA po ninyo ito,” the President said in his 4th SONA at the House of Representatives in Quezon City.

“Sa bawat gurong bumabangon nang madaling-araw para magturo sa kanayunan: SONA mo ito. Sa bawat pulis na nagsilbi at hindi nanghingi ng kapalit: SONA po niyo ito,” he said.
Monday’s address is also the SONA of the people who worked together to find the most qualified leaders during the May mid-term election, he said.

“Sa bawat estudyanteng mulat sa mga napapanahong isyu sa lipunan, at sa halip na magreklamo lang sa Facebook ay nagmumungkahi ng solusyon: SONA mo ito.”

The address is also for those who encouraged others to contribute to nation building and to forget the old, corrupt system, the President further said.

The President also mentioned Brigadier General Ramon Mateo Dizon, the head of the Presidential Security Group (PSG), who will be retiring soon, personally thanking the PSG chief for securing him and the Aquino family. He said his Monday’s address to the nation is the SONA of General Dizon and his wife.

“Chito, nakiambag ka rin sa pagbabago; tunay kang tapat sa watawat, sa Saligang Batas, at sa sambayanang Pilipino. Siyempre, kung di ka inalalayan ng iyong butihing maybahay na si Jo-ann, hindi mo naabot ang iyong mga tagumpay. SONA ninyong dalawa ito,” he said expressing his gratitude to General Dizon.
It’s a long way to go, according to the President noting that there will be challenges and stumbling blocks ahead.

But he said he has full confidence on the abilities of Filipinos to overcome those challenges. “Hindi tsamba ang mga tagumpay na tinatamasa natin ngayon; huwag tayong papayag na maging panandalian lamang ang transpormasyon. Samantalahin natin ang pagkakataon upang gawing permanente ang pagbabago,” he stressed.

The country has always been his source of strength, the President said.

Aquino assures that government continues efforts towards achieving inclusive growth and in gaining confidence of business partners July 25, 2013

President Benigno S. Aquino III assured that his government continues to make strides towards inclusive growth and in gaining the confidence of its partners in business.

“Good governance has cleared the path for our people’s resurgence. We remain firm on this principle, as we continue to invest towards infrastructure and in our greatest resource: the Filipino people,” the Chief Executive said in his message to the delegates and participants of the Manufacturing Technology Cebu 2013.
Machinery, technology, furniture and tourism stakeholders gathered on Thursday at the Waterfront Cebu City Hotel for a three-day forum, “Manufacturing Technology Cebu 2013.”
The event, hosted by Global-Link MP Events International Inc. (GLMP), will end on July 27.
“May this occasion complement our advancement with stronger partnerships that will herald our country’s thriving economic and cultural landscape, and innovations that lend advantages for the Filipino,” the President stressed.

“With your support, we can translate our gains into more opportunities and bring to fulfillment a more prosperous and equitable tomorrow. I urge you to discover for yourselves the competence of our citizens, the richness and diversity of our heritage, and the culture of integrity and excellence that makes business more fun in the Philippines,” he said.
